GENERAL CONDITIONS OF SALE
The offer and sale of products on the web portal www.pasticceriamennella.it are governed by these general conditions of sale. The products are sold directly by www.pasticceriamennella.it, with registered office in Torre del Greco (NA) at Via Nazionale 397/399, tax code and VAT number 08423331217, and Naples company registration number NA 956667.
RECIPIENTS
The products that the seller offers for sale on the web portal are intended exclusively for end users who are consumers, meaning any natural person who wishes to purchase the relevant products for purposes not related to their commercial, entrepreneurial, or professional activity.
CONCLUSION OF THE CONTRACT
The contract will be deemed concluded when the customer's purchase order for one or more products is electronically accepted by pasticceriamennella.it by sending an order confirmation email to the customer's email address. Pasticceriamennella.it reserves the right not to process purchase orders that do not provide sufficient guarantees of solvency, are incomplete, or are incorrect, or in the event of unexpected product unavailability, providing notification via email. By electronically submitting a purchase order, the customer unconditionally accepts the General Terms and Conditions of Sale and undertakes to comply with their content and the privacy policy.
PRICE
The prices of the products listed on the homepage or in the various sections of the site include VAT but do not include shipping costs. They do not include any taxes, duties, or other financial and/or fiscal charges applicable in the country of destination of the products, if this is other than Italy, which will be the sole responsibility of the customer.
DELIVERY
Delivery times do not include Saturdays, Sundays, and holidays. Delivery times longer than those indicated depend exclusively on impediments encountered by the courier and are not considered binding on Artika Srl. Delivery times for in-stock products therefore vary from 2 to 10 days. Delivery times are subject to change during holidays (Christmas, Easter, etc.). If the recipient is absent, pasticceriamennella.it will charge the recipient for storage and redelivery costs, unless the recipient collects the package in person from the courier's warehouse. If the product is unavailable after ordering, we will inform the customer via email as soon as possible and propose a new delivery date. The customer then has the choice of accepting a postponement of the delivery date or canceling the order and receiving a refund.
GUARANTEES
Purchases made by customers are subject to the legal provisions regarding guarantees, including, where applicable, the provisions set forth in the Consumer Code regarding consumer guarantees.
RIGHT OF WITHDRAWAL
Pursuant to art. 59 letters c), d) and e) of the Consumer Code, given the particular nature of the goods offered for sale, the provisions regarding the exercise of the customer's right of withdrawal do not apply.
